Welcome to makantrip.com ("we", "our", "us"). These Terms of Service ("Terms") govern your access and use of our website, mobile application, and services related to the purchase and redemption of food and travel vouchers ("Vouchers").
By accessing or using our platform, you agree to be bound by these Terms.
Acceptance of Terms
By purchasing, redeeming, or using any Vouchers, you acknowledge that you have read, understood, and accepted these Terms. If you do not agree, please stop using our platform.
Applicable Law
These Terms are governed by the laws of Malaysia, including but not limited to:
- Contracts Act 1950
- Consumer Protection Act 1999
- Personal Data Protection Act 2010 (PDPA)
- Communications and Multimedia Act 1998
All disputes are subject to the exclusive jurisdiction of the courts of Malaysia.
Nature of Our Service
We act as a platform that facilitates the sale of Vouchers for food, travel, and related services.
We do not provide the underlying food, travel packages, accommodation, transport, or other services.
All redemptions are fulfilled solely by the respective merchants ("Merchant Partners").
Voucher Purchase (Non-Refundable)
Once purchased, Vouchers are non-refundable, non-exchangeable, and non-transferable, unless explicitly stated otherwise.
- Full payment is required at the time of purchase.
- Each Voucher may have its own specific terms: validity period, usage conditions, blackout dates, peak season restrictions, or booking requirements.
- Users are responsible for reviewing these terms before purchase.
Voucher Redemption
- Users must present the valid Voucher (QR code / e-Voucher / unique ID) for redemption.
- All Vouchers are strictly one-time use only, unless explicitly indicated otherwise.
- Merchants may require advance booking or reservation, especially for travel-related Vouchers.
- The Merchant Partner is responsible for the quality, safety, and fulfilment of the service.
No Duplicate or Fraudulent Redemption
To protect both users and merchants:
- Each Voucher carries a unique identifier.
- Once redeemed, it will be automatically marked as used.
- Any attempt to duplicate, modify, or misuse a Voucher is strictly prohibited and may lead to account suspension or legal action.
Expiry and Validity
- Every Voucher includes a validity period.
- Expired Vouchers cannot be extended, refunded, or exchanged.
- The user is responsible for redeeming the Voucher before expiry.
Merchant Responsibilities
All fulfilment obligations rest with the Merchant Partner, including:
- Product or service quality
- Safety and legality
- Booking availability
- Customer experience
We are not responsible for any issues arising from the merchant's performance.
Data Calculations & Estimated Savings
(Important Clause)
Our platform may present:
- Estimated savings
- Total voucher value
- Discounted amounts
- Sample usage calculations
- Historical savings data
These figures are for reference only and may not reflect actual savings for every user due to:
- Merchant pricing changes
- Seasonal variations
- Limited redemption availability
- Individual usage behaviour
You agree that these calculations are estimations and may not be accurate, and you must not hold the company liable for any differences, discrepancies, or perceived financial loss arising from these estimations.
User Responsibilities
You agree to:
- Provide accurate information during account creation or Voucher purchase.
- Use Vouchers only as allowed under these Terms.
- Not resell, duplicate, tamper, or engage in fraudulent activity.
- Comply with all Malaysian laws when using the platform.
Pricing, Taxes & Payment
- All prices displayed are in Ringgit Malaysia (RM) unless indicated otherwise.
- Prices may include or exclude applicable taxes such as SST.
- We reserve the right to revise prices without prior notice.
Refunds & Cancellations
Refunds are generally not provided, except for exceptional circumstances such as:
- The Merchant Partner permanently ceases operations
- Any refund we determine appropriate under our discretion
Refund timelines may vary depending on payment processors.
Liability Limitation (Malaysia-Specific)
To the fullest extent permitted by Malaysian law:
- We are not liable for any loss, injury, damages, dissatisfaction, or service failures caused by Merchant Partners.
- We are not liable for any indirect, incidental, or consequential damages.
- Our total liability, if any, is limited to the amount you paid for the Voucher.
- Users cannot claim compensation for estimated savings, unavailable promotions, or inaccurate data calculations as stated in Clause 9.
Platform Availability
- We may update, suspend, or maintain our system periodically.
- We are not liable if the platform becomes temporarily unavailable.
PDPA Compliance (Malaysia)
- We process personal data according to the Personal Data Protection Act 2010 (PDPA).
- Our Privacy Notice explains how we collect, store, and use your data.
- By using our services, you consent to such processing.
Termination of Account
We may suspend or terminate accounts that violate these Terms, including:
- Fraudulent Voucher activity
- Abuse, harassment, or misuse of the platform
- Non-compliance with Malaysian laws
Changes to Terms
- We may update these Terms from time to time.
- Continued use of our platform after changes constitutes acceptance of the updated Terms.
